By accessing or using the website at concretemorganhill.com (the "Site") or by engaging Morgan Hill Concrete ("we," "our," or "us") for any services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or engage our services. We may update these terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised terms.
Morgan Hill Concrete is a concrete contracting company based in Morgan Hill, CA. We provide residential and commercial concrete services including, but not limited to, driveway installation, patio construction, foundation work, retaining walls, sidewalks, and decorative concrete. Services are provided within our service area at our discretion. The Site is used to provide information about our company and to accept service inquiries - it is not a storefront, and no binding service agreement is formed through the Site alone.
Any estimate or quote provided through the Site, by phone, or by email is not a guaranteed final price. Written quotes provided after an on-site visit are valid for 30 days from the date issued, unless otherwise stated in writing. Prices may change if the scope of work changes, if unforeseen site conditions are discovered, or if material costs change significantly. We will notify you of any changes before proceeding with additional work. No work will begin without your written or verbal authorization.
Scheduling is confirmed once both parties agree on a start date in writing or by phone. We reserve the right to reschedule due to weather conditions, permit delays, or circumstances outside our control. If you need to cancel or reschedule, please notify us at least 48 hours before the scheduled start date. Cancellations made after materials have been ordered may be subject to a restocking or materials fee as described in your written agreement.
Payment terms are specified in the written agreement for each project. Typically, a deposit is required before work begins, with the balance due upon project completion. Failure to pay on time may result in work being paused until payment is received. Invoices not paid within 30 days of the due date may be subject to a late fee or referred to collections, as described in your project agreement. Accepted payment methods will be listed in your written agreement.
Where a permit is required for the work being performed, we will pull the permit on your behalf and include the associated cost in your written quote. You are responsible for obtaining any additional approvals required by a homeowners association or other private governing body. We comply with all applicable building codes and regulations in the jurisdictions where we work.
To the fullest extent permitted by law, Morgan Hill Concrete shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Site or our services, even if we have been advised of the possibility of such damages. Our total liability for any claim related to our services shall not exceed the total amount you paid us for the specific project giving rise to the claim.
The Site is provided on an "as is" basis without warranties of any kind, express or implied. We do not warrant that the Site will be error-free or uninterrupted. For our concrete services, any warranty on workmanship or materials will be stated in your written project agreement. Concrete is a natural material that may develop minor surface variations, hairline cracks, or color differences over time - these are normal characteristics and are not covered as defects unless specifically stated in your written agreement. We do not warrant against damage caused by soil movement, improper use, acts of nature, or conditions outside our control.
